Likely in Canada the suit would not be considered . . .
. . . But we have Healthcare . . . sort of.
At least in this case he would be taken care of and the med bills would be covered . . .
And the Boyscouts would just have to feel real bad for him . . .
. . . and receive a badge for helping him . . .

A lawsuit that frivilous would never even be considered in Canada, infact if it happened here I doubt anyone would even be charged with negligence.
More to the point who camps under a tree that is dead? Thats asking for trouble to happen.

I missed that part . . . humGremli, an assistant Scoutmaster, was sleeping in a tent when a large tree fell on his legs about 4:30 a.m. last July 22. Gremli was 51 years old at the time.
I guess he should be included as a defendant in the case . . .

I think this happened at a summer camp, and there, tents are provided and are already set up. Scouts and Scouters have no choice of where to put the tent up. I don't think this makes any difference in the validity of the case, but he really isn't completely at fault for camping where he did.
The tents are usually set up three months ahead of time by Scouts going through their OA Ordeal.

The tents may have been fixed but what was to keep him from checking out the area and saying, "Hey I am not camping here as there is a rotten tree by the tent"
I am still 18 but with 52 years of experience !
I could understand if it happened to one of the scouts and a parent wanted to sue...but um...yeah the assisstant scoutmaster...is he sueing himself too?
This sounds like what happens when pressure mounts (bills, etc) and peoples principles get compromised.
