Actually, Sol_Invictus would have dibs with this line: "I will take it pending questions". It can't get any clearer than that. Sol_Invictus would have to let it go to the next person only if he chose to. I know it seems like a grey area, but we go by first "I'll take it" posts... what's your reasoning?

I have send funds but will abide by any forum rules. it does seem a gray area that someone can tie up a sales by stating "I'll take it, pending questions". An offer to buy with a contingency is not the same as an offer with no contingency. Maybe "I'll take it pending question" could mean I'll buy it if you will take a lowed price. We don't know. I'm sure that this was not the case here but if the rule is that "I'll take it pending question" is the same as I'll take it then I suspect we will see a lot more of the type of reply in the For Sale posts. It's a tricky ruling.
As stated I will abide by any ruling offered.

I've pm'd the mods explaining my reasoning for selling to sidewinder first. I have to tend to agree that I feel I'll take it "pending questions" is not a solid offer to purchase which is why I sold to you first. I agree that it would tie things up in the forums without having to really commit to purchasing something (I don't think this was Sol's intention). However, I will follow the mods final decision. And no disrespect to sol. I was trying to do what I thought was fair and best followed the spirit of the forum rules.

Yeah, sorry NCPatrick, but that's a conditional acceptance. It's not reasonable to allow a buyer to unilaterally exercise an option to buy on the seller. The forum rules, as written in the sticky, comport with that.
Don't be sorry. We have been ruling the opposite way than you describe. An "I'll take it" is an "I'll take it", questions or not. There are no rules (yet) regarding conditionals, so one could assume that there are none.

I do remember reading a fairly recent post where a Moderator was involved and I thought that it was made clear that an offer with pending is not the same as offer with no contingency. I won't have time to research until later today but that is what I'm remembering as the ruling at the time.

Well I didn't intend to cause so much confusion. I do want the item, but I just wanted to ask about how true to size and temp the top quilt was before I bought it.
I would think there has to be provision in this "I'll take it" policy to make sure that the used items we're buying are what we actually want. Especially when buying high priced items.
I figured as long as the size and temp matched the ratings, I would pay for the item. I did not intend to "hold up" the sale. If for some reason the quilt didn't deliver on its measurements, I would then back out for the next interested person in line.
